1. Introduction

These Terms and Conditions govern the services provided by Stéphane Mikaël Bottine, trading as dxbPT ("the Trainer"). By engaging the Trainer's services, the client ("the Client") agrees to be bound by these terms.

2. Contact Information

3. Services Offered

The Trainer offers the following services: i. One-on-one personal training sessions, which may include nutritional advice upon request. ii. Group sessions with up to 2 participants. A 50% discount is available for the second participant. iii. Online coaching.

Services are provided at: i. A mutually agreed commercial gym. ii. The Client’s home, if preferred. iii. Online, via digital platforms.

4. Payment Terms

  • Rates: The Trainer will confirm rates in writing based on the Client’s specific requests.

  • Payment Method: Payment is accepted in cash only.

  • Payment Schedule: Payment must be made upfront for the agreed number of sessions, typically 12 or 20 sessions.

  • Late Payment: Payments must be made on or before the due date. Failure to make payment will result in the suspension of services until payment is received.

5. Session Policies

  • Duration: Each session lasts for one hour on the gym floor for in-person training.

  • Scheduling: Sessions are scheduled in writing and confirmed via Google Calendar invites.

  • Client Cancellations: If the Client cancels a session on the day, the session will be deemed as used. Cancellations made before the training day may be rescheduled.

  • Client Missed Sessions: Missed sessions will be deemed as used.

  • Client Lateness: If the Client is late, the session will still end at the originally planned time unless the Trainer agrees otherwise.

  • Trainer Cancellations: If the Trainer cancels a session, an alternative session will be offered on another day.

  • Trainer Missed Sessions: If the Trainer misses a session, an alternative session will be offered.

  • Trainer Lateness: If the Trainer is late, the session will be extended on the same day or during a subsequent session to make up for the lost time.

6. Health and Safety

Prerequisites: Clients should obtain medical clearance prior to commencing training if there is any doubt about their health status.

Health Responsibility: The Client acknowledges responsibility for their own health and fitness.

Nutritional Advice: Clients must disclose any allergies or nutritional intolerances if seeking or receiving nutritional advice from the Trainer.

7. Liability

Limitation of Liability: The Trainer will not be liable for any injuries sustained during training sessions, except where caused by the Trainer's negligence.

Waiver: By engaging the Trainer's services, the Client waives any claims against the Trainer for injuries, loss, or damages incurred during training sessions.

8. Privacy and Confidentiality

Data Protection: The Trainer will keep private client information confidential and will not share it with third parties. This information will be retained for no longer than one year.

Marketing Consent: Any use of client testimonials or images for marketing purposes requires written consent from the Client. This consent may be revoked by the Client at any time in writing.

9. Refund Policy

Non-Refundable Payments: All payments made for services are non-refundable, unless the Cooling Off Period applies.

Cooling Off Period: The Client may request a full refund within a 7-day cooling-off period, subject to a 100 AED administrative fee. This refund policy applies only if no sessions (whether paid or unpaid) have taken place within that period.

10. Free training session

Our initial training session is paid for (at a cost of 400 AED if we train at Binous gym or Train SF Al Quoz, and AED 500 otherwise). However, we'll credit any amounts paid against the cost of any 12- and 20-session package you purchase in the 30 days that follow that session.

11. Termination of Services

Expiry of Sessions: Purchased sessions expire automatically within 60 days of purchase.

Extension of Expiry: If sessions remain unused due to reasons beyond the Client’s control, the Trainer may extend the expiry date as a gesture of goodwill. Any such extension must be agreed upon in writing.

12. Dispute Resolution

Amicable Resolution: In the event of a dispute, both parties agree to seek an amicable resolution within 14 days before pursuing other methods such as mediation or arbitration.

Governing Law: These terms and conditions are governed by the laws of Dubai, and any disputes will be subject to the jurisdiction of Dubai courts.
